First District Court of Appeal to hear City impact fee case Wednesday

The State of Florida’s 1st District Court of Appeal  will hear oral arguments in the City of Fernandina Beach vs the Appellant Joanne Conlon Wednesday, January 15.  The start of the City’s oral arguments is estimated to be around 10:00 a.m.  The Fernandina Observer will post an alert shortly before the precedings begin.

The panel assigned to hear oral arguments are Judges William Van Nortwick, Jr., Philip J. Padovano, and Lori S. Rowe.  Before the court is the portion of the impact fee case regarding  Class Certification.

Representing the City of Fernandina Beach are Douglas B. Brown, Darren A. Schwartz,  David B. Shelton, and Brian L. Hayden  of Rumberger Kirk Caldwell, P.A.  Douglas B. Brown will  present oral arguments for the City.

Representing the appellant Joanne Conlon are Michael G. Tanner, Gilbert L. Feltel Jr., and C. Matthew Detzel of Tanner Bishop, and E. Clinch Kavanaugh III, of Clinch Kavanaugh P A.

All I can say is:
“Remember The Airport Lawsuit”.
Does anyone really know just how much defending that duck cost us? Let’s not make that mistake again!
