Court upholds Fernandina Beach annexation of Palms at Amelia Condos

City Attorney Tammi Bach reported at the July 1, 2014 Regular Meeting of the Fernandina Beach City Commission that the city has prevailed in a petition filed on behalf of the Palms at Amelia Condominium Association for Writ of Certiori (City Ordinance 2013-04).

Circuit Court Judge Suzanne Bass in a decision dated June 27, 2014,  has found that “the decision of the City Commission of Fernandina Beach of June 4, 2013 [to annex the Palms at Amelia into the municipal limits of the city] was supported by competent substantial evidence, that the Plaintiff was accorded due process, upon stipulation, and the essential requirements of law have been observed.”

It remains to be seen if the Palms Condominium Association will appeal the Judge’s ruling.  The condos are located at 1601 Nectarine Street.
