Fernandina Beach Impact fee lawsuit – Attorneys’ fees begin to accumulate

The Jacksonville Business Journal is reporting in an article entitled “Fernandina Beach water fee lawsuit set to move forward,” that a Judge {Judge Brian Davis} denied the summary judgment brought forth by the City of Fernandina Beach to dismiss the impact fee lawsuit. The lawsuit was initially filed in 2011 by the Jacksonville law firm of Tanner and Bishop and local attorney Clinch Kavanaugh.

According to City Finance Director Patti Clifford, the expenditure for attorneys’ fees to date amounts to $139,927.11. A portion of the total is for attorneys’ fee paid for legal services to challenge the City’s liability insurer’s refusal to pay for attorneys’ fees related to impact fees. The law firm of Adams Reese, formally Volpe, is representing the City to challenge its liability insurance company to cover costs for the impact fee lawsuit.

When asked for a statement City Attorney Tammi Bach replied, “Officials just received these orders today, so please give us some time to review before we comment.”
